Terms & Conditions for Students

1. Page Talent

When using or visiting the Page Talent website ('Website') you agree with all of the provisions included in this document and you are entering into an agreement with the Dutch limited liability company Page Interim B.V. (with statutory seat at Strawinskylaan 421, 1077 XX, Amsterdam, the Netherlands) (hereafter referred to as “PP”, and/or: "we" "us" and "our".

2. Services

2.1 PP offers services on the Website. All functionalities, content and/or application of the Website are to be considered part of these services (“the Services”).

3. Acceptance and registration

3.1 The terms of use set out the condition on which you are allowed to use the Services. By using these Services you agree to the terms of use included in this document. Please read these terms carefully. If you do not agree to one or more of the terms included, please do not or no longer visit the Website or use the Services.

3.2 If you would like to create an account on the Website and use the Services, please read these terms of use carefully and accept them in the registration process.

3.3 You should immediately inform us on any change in the information you have provided to us upon registration and you should keep all information up to date. This allows effective communication between you and us.

3.4 Upon registration you will be asked to create a password. You should keep this password confidential to avoid fraudulent acts; you may not disclose the password to any other party. If you know or suspect that anyone else knows your password, you must let us know immediately through https://www.pagetalent.nl/contact.

3.5 If PP in its absolute discretion believes that there may be a security breach or irregular activity on the Website you may be required by us to change the password. Alternatively, we can suspend or delete your account.

4. Amendments

4.1 PP may amend these terms of use at any time. Such amendment will apply to you upon listing the amended terms of use on the Website. You agree to these amendments upon visiting the Website or using the Services after the amended terms have been included on the Website. If you do not agree to the amended terms, you are not or no longer to use the Website and/or the Services.

5. Your use of the Page Talent Website

5.1 You may not use this website for:

5.1.1 Spreading illegal, intimidating, blasphemous, insulting, threatening, harmful, vulgar, obscene or otherwise inappropriate material or otherwise breaching applicable laws and regulations;

5.1.2 Sending material that encourages criminal behaviour, or that may result in civil liability or otherwise is in breach of applicable laws and/or regulations or codes of conduct.

5.1.3 Limiting the use of the Website by any other person;

5.1.4 Making, sending or storing electronic copies breaching third party intellectual property rights without PP authorisation.

5.2 You will be liable towards PP for all damages and costs that result from or relate with you breach of any condition included in these terms of use. You acknowledge that we are not obliged to offer products and or services to the Website. We are allowed to contact you on any information you have provided to us.

6. Period and your suspension/termination rights

6.1 These terms of use remain valid during your use of the Website and/or the Services.

6.2 You may terminate your registration at any time on the Website through the link: Account Termination in the last e-mail message you have received or by indicating so at your MyPage-account. Suspension or termination of your account does not influence or limit any legal or contractual right or liability of any party.

7. Intellectual property

7.1 All information included in the Website is the exclusive property of PP or is licensed to PP. You may never reproduce, amend, copy, spread or commercially use any material or contents of the Website.

8. Privacy policy en Cookie policy

8.1 Our Privacy policy applies to these terms of use and to the use of the Website. Our Privacy policy may be found at https://www.pagetalent.nl/privacy-beleid. This Privacy policy explains which personal data are being processed for what purposes and in what way.

8.2 Our Website also provides our Cookie policy listing information on cookies that we use, information that we collect and the purpose of that information as well as the categories of information collected. You may find this Cookie policy on: https://www.pagetalent.nl/cookie-policy.

9. Miscellaneous

9.1 You may not transfer any of these terms of use to any other party. We may transfer these terms of use to any other party if may reasonably believe that your rights under these terms of use are not affected.
 

9.2 Any initially ignored breach of these terms of use  does in no way limit PP’s rights and actions to –to the extent reasonable- enforce its rights at later time or in another situation in which you have breached the terms of use.


9.3 PP is not responsible and/or liable for any breach of these terms of use outside its reasonable control.

9.4 The website is owned and controlled by PP. These terms of use are governed and enforced in accordance with Dutch law. Any dispute will be

exclusively submitted to the District Court of Amsterdam, the Netherlands.

Terms & Conditions for Employers

1. Page Talent

1.1 When using or visiting the Page Talent website ('Website') you agree with all of the provisions included in this document and you are entering into an agreement with the Dutch limited liability company Page Interim B.V. (with statutory seat at Strawinskylaan 421, 1077 XX, Amsterdam, the Netherlands) (hereafter referred to as “PP”, and/or: "we" "us" and "our").

2. Registration

2.1 In order to use the Website of Page Talent, employers (“Employer(s)”) must register online. After registration, Employers will receive an e-mail to verify the e-mail address. Upon verification of the e-mail address, verification of the account of Employer will be completed within 24 hours as of verification of the e-mail address, following which Employer may post positions on the Website.
 
3. Services

3.1 PP offers services on the Website. All functionalities, content and/or application of the Website are to be considered part of these services (“the Services”).

4. Positions and Employer profiles

4.1. Employers may post positions and advertisements on the Website provided that such post meets the terms included in these terms of use.
 
4.2. Positions that can be posted by the Employer are:
 
•    Paid internships/apprenticeships/traineeship
•    Unpaid internships/apprenticeships/traineeships not exceeding 12 weeks
•    Temporary labour or holiday tasks (in Dutch: vakantiewerk)
 
 4.3. Positions that Employers are not allowed to post on the Website:

•    Fulltime or part-time jobs in which at least the national minimum wage is paid
•    Positions for students that have graduated
•    Positions that provide for payment on commission basis
•    Positions for temporary workers or independent contractors)
•    Multiple advertisements on the Website for one and the same position
•    Positions through head-hunters, recruitment agencies or other intermediaries
•    Positions that PP considers (potentially) in conflict with Dutch labour law or any other applicable rule or regulation.
 
4.4. PP has the right to routinely and regularly verify whether positions posted by Employers meet the applicable rules and regulations and/or these terms of use.
 
4.5. PP may at its absolute discretion refuse to post positions and/or Employer profiles or to amend or delete such positions and/or Employer profiles even if these had initially been accepted.
 
5. Employer Representations and Warranties and indemnification

5.1 Employers represent and warrant that:
 
a.    Positions or Employer profiles that are posted on the Website do not breach any applicable law or regulation nor do they breach any intellectual property right (such as copyrights and or trade mark rights or any other rights);
 
b.    All information provided by Employer in relation to the position or the Employer profile is correct, complete and true in all aspects;
 
c.    Positions and Employer profiles meet all applicable Dutch law provisions in the Netherlands;
 
d.    Positions and Employer profiles and any other post submitted to PP meet the Dutch Reclame Code regulations and any other applicable advertisement code or regulation of the Dutch Reclame Code Commissie.

5.2  Employers indemnify and hold PP harmless for all liability and/or claims relating to the breach by Employer of any of these terms of use and/or any applicable regulation.

5.2 PP is not liable for any damage and/or loss which Employer or any other user of the Website suffers or causes with any other user or any other third party.

5.3 Without the express written permission by PP, the Employer may not directly or indirectly enter into any employment relationship, cooperation or contractual relation of whatever nature with a candidate (“the Candidate”) for a period of 18 months after the Employer has obtained the information on a Candidate through the Website presented by PP (which includes forwarding information on such Candidate). This provision also applies if the Candidate was presented during that period to the Employer or any of its group companies by a third party (including for example by professional services firms with similar activities as PP) or if the Candidate has him/herself approached the Employer or its group company.  

5.4 The Employer guarantees as jointly and severally liable co-debtor the proper performance of the prohibition referred to in 5.3 above by its group companies.

5.5 The Employer may not pass on in any way to any third party any information on the Candidate(s) that was provided by PP or obtained through the Website nor may the Employer present such Candidate(s) to third parties or use the information of such Candidate in any other way.

5.6 Any breach of this clause results in the Employer immediately (without further notification) forfeiting to PP a penalty in the amount of € 12,500.- notwithstanding PP’s rights to specific performance and/or damages.

5.7 The prohibition included in clause 5.3 up to and including 5.6 above do not apply to positions referred to in clause 4.2 of these terms of use.

6. Use of information that we collect while visiting our Website

6.1 Our Website also provides our Cookie policy listing information on cookies that we use, information that we collect and the purpose of that information as well as the categories of information collected. You may find this Cookie policy on: https://www.pagetalent.nl/cookie-policy.
 
7. Privacy policy

8. Head-hunters/Recruitment.

8.1 Registration on the Website is not allowed for head-hunters/recruitment agencies.

9. Miscellaneous

9.1 These terms of use may be amended from time to time and PP advises to check the terms regularly. These terms of use are governed and enforced in accordance with Dutch law. Any dispute will be exclusively submitted to the District Court of Amsterdam, the Netherlands.
